Terms and Conditions

These terms and conditions (“Terms and Conditions”) govern your attendance at Canon’s stand at photokina 2016 (“Canon Event”) and your participation in any event or activity taking place at the Canon Event site (“Canon Activities”). By attending the Canon Event or by participating in any of the Canon Activities, you agree to be bound by these Terms and Conditions and any others you may be advised of whilst at the Canon Event. As used herein, ‘Canon’ refers to Canon Europa N.V. registered in Amsterdam under registration number 33166721 having a place of business at Bovenkerkerweg 59, 1185 XB Amstelveen, The Netherlands and other associated Canon group companies.

PLEASE NOTE: By visiting Canon’s stand at photokina 2016 or by participating in any of the Activities at the Canon Event you agree and accept that your image (alone or as part of a group) may be captured by photographers in still photographs or videos (“Image”). You also agree that you may be requested for interview but have the right to decline participation in any interview at the time of the request. Canon reserves the right to use your Image and/or voice to promote Canon’s stand at photokina 2016 and future events as Canon may see fit, including, without limitation, on social channels and via online marketing. This means that your Image and/or voice may be uploaded to YouTube and flickr channels associated with Canon and/or photokina 2016.

1. My Canon Pass

1.1 Your My Canon Pass allows you to interact with touch points at the Canon Event to collect personalised content, including (but not limited to) other Canon Event and product-related information (collectively “Souvenirs”); and to then view and retrieve your Souvenirs after (or during) your visit via the My Canon photokina website myphotokina.canon-europe.com.

1.2 The My Canon photokina site, and thus your account, will be de-activated 6 weeks following the close of photokina 2016. Thereafter, Images (photos and videos) can be viewed and downloaded only from the YouTube and flickr channels directly.

1.3 You are fully responsible for keeping your My Canon Pass safe and secure and for all activities and Souvenirs that are associated with your My Canon Pass, whether undertaken by you or any third party. Please remember that when you register your My Canon Pass, a limited amount of personal information will be associated with the card. However, access to your My photokina website is only possible if you sign in using your registered details, including your name and email address - so please ensure that you do not share your registration details with anyone else. Canon shall not be liable for any loss or damage arising from your failure to comply with this clause.

2. Canon Event

2.1 By visiting photokina 2016 or by participating in any of the Activities at the Canon Event you agree and accept that your image (alone or as part of a group) may be captured by photographers in still photographs or videos (“Image”). You also agree that you may be requested for interview but have the right to decline participation in any interview at the time of the request. Canon reserves the right to use your Image and/or voice to promote Canon’s photokina 2016 stand and future events as Canon may see fit, including, without limitation, on social channels and via online marketing. This means that your Image and/or voice may be uploaded to YouTube and flickr channels associated with Canon and/or photokina 2016.

3. Privacy Policy

3.1 For the purpose of this Privacy Policy, Canon Europa N.V. and Canon Europe Limited (3 The Square, Stockley Park, Uxbridge UB11 1ET) are the joint data controllers of your personal information.

3.2 When you register for the Canon Event, any personal data supplied by you will be collected and used by Canon for the purposes of providing you with the services and operation of the Canon Event and, where you have opted in to receive marketing communications, for the purposes of providing you with such communications. By registering for the Canon Event and/or by activating a My Canon Pass, you authorise Canon, other Canon group companies and those authorised by Canon to act on their behalf, to use such data for the purposes described above according to this Privacy Policy.

3.3 From time to time Canon or other Canon Group Companies might use this personal data for marketing purposes or to inform you about other products and services which Canon thinks might be of interest for you. You are always able to opt out of receiving such information at any time by editing the emailing preferences of your account or by unsubscribing using a link provided in all Canon communications. Canon may also use your personal data for internal purposes such as auditing, data analysis, and research to improve Canon’s products, services and customer communications.

3.4 Your personal information might be passed on to other Canon group companies, as well as third party service providers for the purposes of operating and promoting the Canon Event or other purposes as set out in this Privacy Policy. This might involve a transfer of data outside the European Economic Area; in that case, you will be informed and be requested to authorise such transfer. Canon will endeavour to ensure that necessary measures are in place to protect the confidentiality and security of your information.

3.5 Canon is committed to protecting your privacy. Your personal data is held on secure servers and manual files and shall not be processed for any other purpose than those set out in this Privacy Policy. The servers Canon uses to store this information are accessible to authorised staff only and Canon will endeavour to make sure that adequate security measures are in place at all times.

3.6 Small pieces of information known as cookies may be saved on your computer to store information that enables the system to identify your current connection to any Canon website. The cookie will not store any personal data and cannot read data off your hard disk. You can choose not to accept a cookie by enabling your web browser to refuse cookies or to prompt you before accepting one.

3.8 Canon will hold your personal information for the duration necessary and for the purposes set forth above in this Privacy Policy, unless you request Canon to delete it in accordance with clause 3.7.

4. Indemnity

4.1 As a registrant for and participant in the Canon Event and/or Activities, you agree to hold harmless and indemnify Canon, Canon’s subsidiaries, affiliates and subcontractors, Canon’s parent company, any subsidiaries or affiliates of Canon’s parent company and their subcontractors, and their officers, agents, and employees, advertisers or partners, from and against any third party claim arising from or in any way related to your registration and participation in the Canon Event and/or Activities, all your activities and your violation of any applicable Terms and Conditions, including any liability or expense arising from all claims, losses, damages (actual and consequential), suits, judgments, litigation costs and attorneys’ fees, of every kind and nature. In such a case, Canon will provide you with written notice of such claim, suit or action.

5. Disclaimer

5.1 You expressly acknowledge and agree that:
Your registration and participation in the Canon Event and/or Activities is at your sole risk. Canon Event and all related resources, materials and information are provided on an “AS IS” and “AS AVAILABLE” basis. To the maximum extent permitted by law, Canon and its affiliated companies expressly disclaim all warranties and conditions of any kind, whether express or implied, including, but not limited to the implied warranties and conditions of merchantability, fitness for a particular purpose and non-infringement.

5.2 Canon and its affiliated companies do not warrant that registration and participation in Canon Event (including all Activities), provision of resources, materials and information will meet your personal requirements, or be uninterrupted, timely, secure or error-free.

5.3 Any resources and materials (Souvenirs) are downloaded or otherwise obtained from Canon Event at your own discretion and risk and you will be fully responsible for any damage to your computer server or other device or any loss of data that results from the download of any such material.

5.4 No advice or information, whether oral or written, obtained by you from Canon (including its affiliated companies) or through or from registration and participation in the Canon Event shall create any warranty not expressly stated in these Terms and Conditions.

6. Limitation of Liability

6.1 NOTHING IN THESE TERMS AND CONDITIONS SHALL EXCLUDE OR LIMIT CANON’S LIABILITY FOR LOSSES WHICH MAY NOT BE LAWFULLY EXCLUDED OR LIMITED BY APPLICABLE LAW AND EXPRESSLY SHALL NOT EXCLUDE LIABILITY FOR (i) FRAUD OR (ii) DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE OF CANON. You expressly acknowledge and agree that Canon and its affiliated companies shall not be liable to you for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Canon or its affiliated companies have been advised of the possibility of such damages) resulting from: (a) the registration and participation in the Canon Event; (b) unauthorized access to or alteration of your transmissions or data; (c) statements or conduct of any third party relating to the Canon Event; or (d) any other matter relating to the Canon Event.

7. Canon’s Trademark

7.1 No one is permitted to display or use in any manner the Canon or Canon group trademarks or logos without Canon’s prior written permission.

8. Choice of Law and Forum

8.1 Subject to Clause 8.2, these Terms and Conditions and any dispute relating to them or to the Canon Event shall be governed by the law of England and Wales, and disputes relating to these Terms and Conditions or to the Canon Event shall be resolved in the courts of England and Wales.

8.2 As a consumer, you may be entitled to bringing court proceedings in your own language and in your local courts. A local consumer advice organisation will be able to advise you of your rights. These Terms and Conditions do not restrict your statutory rights.
